These General Terms and Conditions (hereinafter the "GTC") govern the relationship between the buyer and the seller in the area of the sale of goods between the business company eMobility s.r.o., IČO 54872286 (hereinafter the "seller"), and its business partners or clients (hereinafter the "buyer").
Article I. — Basic Provisions
By submitting an order, the buyer confirms that they have read these GTC, of which the Complaints Procedure forms an inseparable part, and that they agree with them. The buyer is sufficiently notified of these GTC before creating and submitting an order and has the opportunity to read them.
The seller is the business company eMobility s.r.o., with its registered office at Radlinského 12, 080 01 Prešov, registered in the Commercial Register of the District Court Prešov, section: Sro, insert no. 44654/P. Further information about the seller is provided on this page in the "Contact" section.
The buyer is either a consumer or an entrepreneur.
A consumer is a natural person who, when concluding and performing a contract, does not act within the scope of their commercial or other business activity or within the scope of the independent exercise of their profession. When entering into a business relationship, the consumer provides the seller with the contact details necessary for the smooth processing of the order, or details that they wish to have stated on the purchase document. Legal relationships between the seller and the consumer not expressly governed by these GTC are governed by the relevant provisions of Act No. 40/1964 Coll., the Civil Code, Act No. 250/2007 Coll. on consumer protection, Act No. 108/2000 Coll. on consumer protection in door-to-door sales and mail-order sales, and other related regulations as amended.
An entrepreneur means a person registered in the commercial register, a person who does business on the basis of a trade licence, a person who does business on the basis of an authorisation other than a trade licence under special regulations, and a person who carries out agricultural production and is registered in the records pursuant to a special regulation. Legal relationships between the seller and a buyer who is an entrepreneur, not expressly governed by these GTC or by the contract between the seller and the buyer, are governed by the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended.

A purchase contract may be concluded with a consumer or an entrepreneur. If the buyer is a consumer, the proposal to conclude the purchase contract is the placement of the offered goods by the seller on the pages of its online shop. The purchase contract arises upon the submission of the order by the buyer-consumer and the acceptance of the order by the supplier. The supplier confirms this acceptance to the buyer by means of an informational e-mail sent to the e-mail address provided by the buyer; however, this confirmation has no effect on the formation of the contract. If the buyer is an entrepreneur, the proposal to conclude the purchase contract is the order of goods submitted by the buyer-entrepreneur, and the purchase contract itself is concluded at the moment the seller's binding consent to this proposal is delivered to the buyer.
The seller reserves the right to cancel the contract in cases where a technical malfunction occurred on the seller's pages caused by circumstances beyond the seller's control, or where the ordered goods become unavailable due to being sold out or removed from the supplier's range. Should one of the above situations occur, the seller shall inform the buyer of this without delay and shall send them confirmation of the order cancellation by e-mail.
Relationships and any disputes that arise on the basis of the contract shall be resolved exclusively in accordance with the applicable law of the Slovak Republic and shall be resolved by the competent court.
Article II. — Security and Protection of Information
The seller declares that all personal data is confidential, will be used solely for the performance of the contract with the buyer, and will not otherwise be published or provided to a third party, with the exception of situations related to the distribution of, or payment transactions relating to, the ordered goods (disclosure of name, delivery address, telephone number). Personal data provided by the buyer to the seller for the purpose of fulfilling the order is collected, processed and stored in accordance with the applicable laws of the Slovak Republic. In the process of creating an order, one of the mandatory details is also the provision of an e-mail address, to which the seller will deliver confirmation of the created order and its particulars. By providing an e-mail address, the buyer agrees that the seller may send to the stated e-mail address news, information and promotional materials relating to the subject of the seller's business activity. The buyer may revoke this consent at any time, free of charge, by sending an e-mail from the e-mail address provided when creating their order to the seller's e-mail address info@serviskolobeziek.eu.
Any natural or legal person (hereinafter the "interested party") may subscribe, free of charge and without obligation, to the seller's news and information by entering their e-mail address in the relevant field on the seller's website. The interested party may revoke this consent at any time, free of charge, by sending an e-mail from the e-mail address provided when subscribing to the seller's e-mail address info@serviskolobeziek.eu.
Article III. — Opening Hours – by Appointment
The seller has established a business premises in Prešov at Jarková 6 under the name "Servis kolobežiek eMobility", where part of the range published on its website is physically located. The premises also serve as a collection point for goods ordered by telephone, if the buyer chose the option of collecting the goods at the premises when ordering. The premises are open Monday to Saturday by appointment, at a pre-arranged time and date of collection – visit.
The online shop website www.serviskolobeziek.eu can be visited every day of the year, 24 hours a day.
Article IV. — Price of Goods and Ordering
The price of the goods is stated for each individually offered item on the seller's website, and its amount is binding on the seller. The buyer will be supplied with available goods at the price valid at the time of ordering. The buyer-consumer has the opportunity, before completing the order, to familiarise themselves with the total price of the goods including VAT and all other charges (delivery, etc.). This price will be stated in the order and in the message confirming receipt of the order for the goods.
In the case of special made-to-order goods or goods that are currently not in stock at the supplier, the buyer has the opportunity to verify the delivery date and the final price of the goods with the seller by telephone or e-mail at the numbers or addresses stated on this page in the "Contact" section. If the buyer is a consumer, they must be informed in advance for such goods of the fact that they are made-to-order goods, for which the conclusion of the purchase contract between the two contracting parties occurs only at the moment the offer is specified by the seller.

Article V. — Withdrawal from the Contract
Both a buyer who is a consumer and a buyer who is an entrepreneur are entitled to withdraw from a concluded purchase contract.
A buyer who is a consumer is entitled to withdraw from a concluded purchase contract pursuant to the provisions of § 12 of Act No. 108/2000 Coll. on consumer protection in door-to-door and mail-order sales, as amended, without giving a reason, within 7 working days of the date of receipt of the goods, whereby it is necessary that the letter of withdrawal from the contract is delivered to the seller within the stated period. The buyer also has this right if they collected the goods ordered via the internet in person at the seller's collection point. The buyer-consumer is obliged to return the goods complete, with complete documentation, undamaged, clean, including the original packaging, in the condition and value in which they received the goods. If the returned goods are incomplete or damaged, the seller may reduce the refunded price by a corresponding amount. The money will be returned to the buyer-consumer within 15 days of the effectiveness of the buyer's withdrawal from the contract.
If the buyer decides to withdraw within the 7-day period, they are obliged to deliver the goods to the seller's address together with proof of purchase and the number of the bank account to which the seller is to remit the purchase price paid by the buyer. The buyer must not send goods which they purchased from the seller and wish to return to the seller to the seller's address as cash on delivery. Goods delivered in this way will not be accepted by the seller.
A buyer who is an entrepreneur may agree with the seller on withdrawal from the purchase contract depending on the condition of the returned goods, the lost warranty and the current price of the returned goods. The condition of the goods is subject to assessment by the seller. If terms acceptable to both parties are not agreed, the goods will be returned at the buyer's expense. The seller is entitled to charge the buyer any further costs incurred.
Article VI. — Payment Terms
The buyer may pay the agreed amount of the purchase price by means of:
- payment in advance by bank transfer,
- payment in cash upon collection of the goods at the collection point,
- cash on delivery upon delivery of the goods (the cash is collected from the customer by the carrier).
The goods remain the property of the seller under reservation of title until the agreed purchase price is paid in full.
Article VII. — Delivery Terms
Personal collection. The goods may be collected at the seller's premises during opening hours. The goods may be collected only by the buyer or a person authorised by them, who shall competently and credibly prove their entitlement to collect the ordered goods by means of an authorisation and a valid identity document.
Delivery by courier service. The goods may, under agreed conditions, be delivered to the buyer by a courier service. The price of transport is governed by the price list valid on the day of the order.
If the buyer refuses to accept the ordered goods, the buyer undertakes to reimburse the seller for the costs associated with handling in the amount of EUR 20.00 pursuant to Act No. 120/2014 on consumer protection.
Delivery of goods is subject to stock availability. For some brands we do not have a stock system, and it may therefore happen that at the time of ordering the given product is already sold out, of which the customer will be informed as soon as possible by e-mail or telephone.
Article VIII. — Warranty Terms
The warranty terms for the goods are governed by the seller's Complaints Procedure and the applicable legal regulations of the Slovak Republic. A complaint within the warranty period may be claimed by the buyer only on the basis of a completed warranty card. If the purchased goods do not have a warranty card, the purchase document serves as the warranty card.
Article IX. — Final Provisions
These GTC are effective from 1. 11. 2022. The seller reserves the right to amend these GTC without prior notice.
